February 19, 2016 -- William Lewis Payton, 42, was charged with murdering 27-year-old Tonya Lynn Amerson.

The victim's body was dismembered, placed in garbage bags, and dumped behind a Target in Huntsville, Ala. 

The charges were dismissed due to available evidence. 

The crime occurred in Oct., 2015. 

The wait for forensic evidence is cited as the holdup in moving forward with the murder charge. Prosecutors filed a motion Tuesday seeking to "nolle prosse" the case, meaning that the murder charge will be dropped - at least temporarily.

"While the state anticipates that additional evidence will be obtained through forensics, the state has no timeline for when that evidence will be available," the motion reads. "Accordingly, no new evidence will be presented in this case that has not already (been) presented to the Circuit Court. While the state intends to take this matter before the grand jury once all evidence collection is finalized, the state does not wish proceed in this matter at this time in light of the reasons set out above."

  1. I like Kenn, but I think this headline is a little deceiving. The headline makes it sound like the man will get away with murder, but the story indicates they are waiting to get more evidence. Of course, there is still the question of why they aren't holding him; he seems a flight risk.
