Investigators say Scarber and McClellan got into a physical altercation “over Scarber shoveling snow.” After the incident, McClellan and his 31-year-old wife Shamika Benton and a friend 42-year-old Cleve McKenzie fled the scene.
Benton was found by police in a home in the 1200 block of North Pennington. McClellan and McKenzie were interviewed by detectives at the police department shortly after.
“At the direction of the District Attorney, McClellan has been charged with Involuntary Manslaughter (4th Degree Felony). He is currently being held in the Hobbs City Jail without bond. At this time, neither Benton nor McKenzie have been charged with any crime. The investigation into Scarbers’ death is on-going,” Police said in a release.
Police found Scarber lying on the ground unresponsive just before 1:00 p.m. Thursday. Officers began CPR until paramedics arrived and took Scarber to the hospital, where he was pronounced dead.
CBS 7 is awaiting a return call from Hobbs Police to ask further questions about the circumstances surrounding the incident.
