DAILYKENN.com -- Justin Marshall, 25, is set to go to trial after the United States Supreme Court declined to hear his case.

Marshall, who is black, is accused of murdering John Versypt, 64, in Iowa City, Iowa. The crime occurred in 2009.

Versypt was white.

According to press-citizen.com:

Marshall, 25, is accused in the 2009 murder of Iowa City landlord John Versypt, 64, who was gunned down in a stairway at the Broadway Condominiums (now called Orchard Place) on Broadway Street, in southeast Iowa City. Police and prosecutors say the case is one of a robbery gone wrong. Marshall was found guilty of first-degree murder in 2013 and sentenced to life in prison, but that verdict was overturned on appeal. The Iowa Supreme Court affirmed part of the appeal's verdict last June, ordering Marshall a new trial.
